Dear Congresscritter:
It is evident, given the passing of Proposition 8, that some people have conflated their religious beliefs with the civil institution of marriage as outlined in California Family Code ยง 300 et seq.
As this conflation has actively endangered between ten and twenty thousand existing marriages as well as been a huge contributor to the impairment of future same-sex marriage, I believe the correct approach is to remove the source of the conflation from the family code.
Therefore, I would like to propose a Separation of Church and State Marriage Act, which would strike out the following sections of the California Family Code:
400(a), which states that clergy and authorized religious representatives can perform civil marriages;
402, which permits the county to license religious institutions to perform marriages;
The following portion of 422(c): ", or of the denomination of which that person is a priest, minister, rabbi, or other authorized person of any religious denomination";
